Renters Terms

The use of this web site, azredirentals.com, signifies that you have read, understand and agree to the terms herein. We reserve the right to change, modify, add or delete any portion of these TERMS OF USE at any time without notice. If any changes occur, we will post that there has been a change and the date change is to take affect. Continued use of the web site after changes have been made constitutes your acceptance of the new TERMS OF USE. If you do not agree with, or will comply with the TERMS OF USE or any changes to the TERMS OF USE, do not access this web site. It is your responsibility to regularly review these TERMS OF USE.

REGISTRATION AND MEMBERSHIP

To register and become a member of azredirentals.com aka as Real Estate Direct, Inc. further referred to herein as REDI, you agree to pay a registration fee in the amount of $60. This registration lasts for an initial period of 3 months. Renewal of registration may be available at no additional costs, at the sole discretion of REDI, if after 3 months you are at the same address. Proof of residency will be required for renewal, and must be done in person at our office. Membership is for individuals seeking a place to rent. Upon paying registration fee, members will have access to our data base for properties that match their particular requirements. REDI reserves the right to limit the number of properties provided.

USE OF SERVICE AND CONFIDENTIALITY

Members of REDI, which are individuals that have registered and paid for access to the web site, agree to keep the information absolutely confidential and agree not to share or disclose the information or login username and password with any person or entity for any purpose. The information obtained herein is for the sole purpose of location housing for the members individual and personal use. It is further agreed by member not to use the information for any corporate purpose including, but not limited to, reselling information, soliciting property management, scraping listings, and Real Estate investment business without the written consent of REDI. Members agree that information obtained is proprietary to REDI and that any misuse of the information is a breach of this contract and is subject to prosecution and monetary recovery of damages by REDI. It is also understood by member that any misuse of information is also a violation of Arizona law governing trade secrets; misuse is subject to prosecution by government authorities and monetary recovery of damages by REDI. REDI reserves the right to suspend, disable or terminate any member account for suspicious usage activity, including concurrent login sessions, group usage, usage from a range or variety of IP addresses, suspected non personal use, corporate use as well as abnormally high usage levels. REDI is the exclusive arbiter of types of usage that is deemed to be suspicious and warrants account suspension, disablement, or termination.

WARRANTY OF ACCURACY OF INFORMATION

REDI makes an honest and diligent effort to acquire accurate information furnished by landlords of property. We take most of our information over the phone and we ask approximately 30 questions to obtain as much information as possible. Therefore, the information, representation and description of rentals will reflect the information given to us by the landlord, or property manager. Accordingly we cannot warranty nor be responsible for the accuracy of property descriptions or conditions. REDI calls every landlord 1-2 times per week to for verification of availability, however, all listings are subject to prior rental.

FAIR HOUSING ACT

All housing listings are subject to the federal and Arizona fair housing laws which make it illegal to indicate in any advertisement any preference, limitation, or discrimination because of race, color, religion, sex, physical or mental disability, familial status (e.g. “no children”), sexual orientation, ancestry, marital status, or source of income. CONTRACT

By registering and paying registration fee, it is agreed that the client entered into a binding contract with REDI. At the time of sign up, the client agreed to the terms herein using a binding digital signature. It is agreed that this contract constitutes full and complete payment for services described in this contract. REDI is a full service Real Estate company licensed by the Arizona Department of Real Estate. REDI is in the business of real estate, property management, and advance fee rental service. By registering with REDI for the purpose of locating a rental property, REDI agrees to make available to client via the internet, listings obtained by REDI. REDI does not represent or act as agent on behalf of the owner of the properties listed except for those contracted for property management purpose. REDI does not guarantee the accuracy of information provided by owners, managers, agents, or representatives of any residential unit listed and made available to client of REDI although REDI will make every effort possible to provide accurate information to client. REDI does not promise that client will enter into agreement with any owner of any property listed by REDI for the rental of any residential unit. It is agreed by both REDI and client that the service provided is limited to providing information to client as to residential units reasonably believed to be available for rental, and that every good faith effort feasible to ensure on current and up to day listings are provided to client.

This contract is for the exclusive use of the purchaser. Proper identification must be presented with proof of registration each time additional rental information is requested in office. Any person who purchases rental information for purposes other than that of locating a rental unit for personal use shall be liable for $5,000 of liquidated damages for each violation.

CANCELLATION & REFUND POLICY

The registration fee is for the information on rental properties, therefore, once information is received a cancellation and refund cannot be provided.

IMDEMNITY

You agree to indemnify and hold REDI, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the service in violation of the agreement or you violation of any low or the rights of a third party.
